Okay, beyond the Legal problems here (Many, many legal problems) there's also some major Logistical problems here. Who are you going to get to do the Labor, in the desert, without using Immigrants? A good indicator on whether or not a President actually thinks that something is an emergency is whether or not FEMA (Federal Emergency Management Agency) is eventually involved. If not, they know it's not an emergency.
